In Part The First of this two part series, we examined an email David Flash sent to a Fort Davis, Texas resident from a Holiday Inn Express in Corpus Christi, at 3:34 in the morning before new years eve. He sent it from his personal email address, which makes sense, since Big Bend Times isn’t a real business. But if he were serious about Big Bend Times, he would have setup an email using the “business” domain name. Anyway, here in Part The Second, we examine the second email he sent that morning, just a few minutes later.
That emails says he is writing in his capacity as Vice President of Marketing at K&M Steam Cleaning. David later would write that the president himself sent the email, but that’s not true. He did copy the president of K&M Steam Cleaning, Ken Moncebaiz’s, personal email address. I can only imagine what Ken must have thought when he saw David’s email threatening legal action by K&M against a local West Texas Journalist for doing nothing more that reporting the news.
The letter starts out with his usually bluster, claiming unlawful conduct and copyright infringement. He claims it’s a demand letter, but letters are sent in the mail. Someone could be forgiven for thinking that a person who sends emails claiming they are legal demand letters, at 3:38AM, might be a methhead.
Flash goes on to complain about this site using an image from K&M Steam Cleaning’s website. Flash has posted our original photography many times on his own website. Several of them are clearly marked with copyright info embedded in the picture. Flash uses them anyway. He posts them to his smear site and defames this site. We have never reported Flash’s use of our pics. He is allowed to do this under the Fair Use provision of copyright law. As are we.
The story surounding the blogger David Flash and K&M Steam Cleaning is certainly in the public interest. Everyone in the Big Bend region wonders what could be going on in Ken Monzebaiz’s head to continue employing someone that creates so much trouble. It’s just a matter of time before Flash’s antics become well know in Austin.
Perhaps Ken didn’t know what he was getting himself into until it was too late. At this point it appears Flash may have total control of K&M’s online presence. If Ken fired David, he would have a lot of work to do recreating accounts across all of the platforms. The other option is that Ken is aware of what is going on and he is fine with it. This would be interesting, as his business could be in big trouble once people realize what he is enabling.
Next Flash goes on and on about “defamatory” statements related to K&M. The article he is referring to is here. The statements there are questions and opinion, and that’s protected speech. In America people have the right to voice an opinion. Ken’s lawyers have surely let him know that. But of course this is just more of Flash throwing things out in an email at 3:38AM hoping he will scare our publisher. It’s our publisher’s opinion that Flash was smoking meth or snorting Aderall that night. Might not be the case, but probably, in her opinion.
Finally, Flash whines about our call to duty. We asked people who believe that Flash is not a good representative of K&M to give them a call at 512-836-8900 and let them know what you think. If I were a business owner and my VP of Marketing was acting like Flash does, I would want to know. Maybe send Ken an email. It’s in David’s email below.
As in Part The First, Flash then lists his demands. They are a heinous attack on the First Amendment. Flash claims to be a journalist but then attacks a real journalist’s Constitutional Rights. He follows up with the same bluff in his previous email. Respond in 48 hours or the lawyers are coming. That was on December 30th, 2025.

BigBendTimes.org has published an image of a K&M Steam Cleaning service van that is K&M Steam Cleaning’s intellectual property.
That image was shot, composed, and created by K&M Steam Cleaning for our marketing and business use and appears on the official K&M Steam Cleaning website. You do not have permission, license, or authorization to reproduce, display, or distribute this image in any form.
This constitutes copyright infringement under federal law. K&M Steam Cleaning takes the protection of its intellectual property seriously.
Defamation and False Statements
Your website has published false and reckless statements implying that K&M Steam Cleaning is engaged in improper, deceptive, or unethical conduct, including insinuations that the company is participating in or benefiting from misconduct or harassment.
Those statements are false. K&M Steam Cleaning is a legitimate, established business that employs many people who rely on the company to support their families. We do good work, operate lawfully, and do not engage in the conduct suggested on your site.
Publishing defamatory statements about a business that harm its reputation and relationships is not lawful.
Improper Use of K&M Steam Cleaning’s Name and Phone Number
Your website also improperly published K&M Steam Cleaning’s business phone number and invited third parties to contact the company in connection with false allegations and harassment.
This conduct is intended to cause disruption, confusion, and reputational harm and constitutes interference with business operations.
Demand
Accordingly, K&M Steam Cleaning demands that you immediately:
Remove the K&M Steam Cleaning van image and any other K&M intellectual property from BigBendTimes.org;
Remove all references to K&M Steam Cleaning that contain false, misleading, or defamatory statements;
Cease using K&M Steam Cleaning’s name, imagery, address, or phone number in connection with defamatory content;
Cease any publication implying misconduct by K&M Steam Cleaning; and
Confirm in writing, within 48 hours, that you have fully complied.
If you fail to comply promptly, K&M Steam Cleaning will pursue all available legal remedies, including but not limited to claims for copyright infringement, defamation, and damages arising from interference with business operations.
Nothing in this letter constitutes a waiver of any rights or remedies, all of which are expressly reserved.
